证监会网站近日挂出牛散景华操纵仁东控股的处罚决定书，证监会认定，景华在2019年6月3日至2020年12月29日期间，操纵83个证券账户，交易仁东控股股票，决定处以罚金500万元。
值得一提的是，根据证监会认定的结果，景华一年半眼花缭乱的坐庄操纵，结果是亏损近27亿元。
仁东控股于2020年12月“庄家崩盘”风波中，以14个跌停板带崩“庄股”阵营，震动市场，案件涉及多家券商、融资方。
从证监会公布的调查细节来看，景华操纵仁东控股股价的行为，达到了情节严重的标准，或构成操纵证券市场罪。不过目前仅仅公布了行政处罚决定书，并未披露景华的行为涉嫌构成犯罪、移交司法机关处理的情况。
该案是否会被移交公安机关进行刑事追诉，尚需等待相关部门查证。

什么是操纵市场证券罪？
操纵证券市场罪是指以获取不正当利益或转嫁风险为目的，集中资金优势、持股或持仓优势、利用信息优势联合或连续买卖，与他人串通进行证券交易，操纵证券市场交易量、交易价格，制造证券市场假象，诱导或者致使投资者在不了解事实真相的情况下作出证券投资决定，扰乱证券市场秩序的行为。【法条原文】
《刑法》第一百八十二条规定：
有下列情形之一，操纵证券、期货市场，情节严重的，处五年以下有期徒刑或者拘役，并处或者单处罚金；情节特别严重的，处五年以上十年以下有期徒刑，并处罚金：
Whoever commits any of the following acts by rigging stock prices in order to obtain illegitimate profits or transfer risks shall, if the circumstances are serious , be sentenced to fixed-term imprisonment of not more than five years or criminal detention and shall also, or shall only, be fined not less than one time but not more than five times the illegal gains:
（一）单独或者合谋，集中资金优势、持股优势或者利用信息优势联合或者连续买卖，操纵证券交易价格的；
(1) rigging stock prices by working alone or plotting with another in concluding transactions jointly or continuously through a mustering superiority in the holding of funds or shares or in the use of information;
（二）与他人串通，以事先约定的时间、价格和方式相互进行证券交易或者相互买卖并不持有的证券，影响证券交易价格或者证券交易量的；
(2) affecting stock prices or the volume of stock transactions by colluding with another and carrying out stock exchange between themselves upon a time, at a price and in a manner previously agreed, or buying or selling between themselves the securities they do not hold;
（三）以自己为交易对象，进行不转移证券所有权的自买自卖，影响证券交易价格或者证券交易量的；
(3) affecting stock prices or the volume of stock transactions by taking himself as the counterpart of transaction and trading in stocks with himself without transferring ownership of the stock; or
（四）以其他方法操纵证券、期货市场的。单位犯前款罪的，对单位判处罚金，并对其直接负责的主管人员和其他直接责任人员，依照前款的规定处罚。
(4)rigging stock prices by any other means. Where a unit commits any of the crimes mentioned in the preceding paragraph, it shall be fined, and the persons who are directly in charge and the other persons who are directly responsible for the crime shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention.
《证券法》第五十五条规定：
禁止任何人以下列手段操纵证券市场，影响或者意图影响证券交易价格或者证券交易量：
Manipulation of the securities market to affect or attempt to affect the trading price or volume of securities by any person by any of the following means shall be prohibited:
（一）单独或者通过合谋，集中资金优势、持股优势或者利用信息优势联合或者连续买卖；
(1) Alone or by conspiracy, concentrating advantages in terms of funds, shareholding, or information to purchase or sell securities jointly or continuously.
（二）与他人串通，以事先约定的时间、价格和方式相互进行证券交易；
(2) Colluding with any other person to trade in securities mutually at the time and price and in the manner as agreed upon in advance.
（三）在自己实际控制的账户之间进行证券交易；
(3) Trading in securities between accounts under the person's actual control.
（四）不以成交为目的，频繁或者大量申报并撤销申报；
(4) Placing and canceling orders frequently or in large numbers, not for the purpose of consummation of trades.
（五）利用虚假或者不确定的重大信息，诱导投资者进行证券交易；
(5) Inducing investors to trade in securities, by using false or uncertain material information.
（六）对证券、发行人公开作出评价、预测或者投资建议，并进行反向证券交易；

操纵证券市场行为给投资者造成损失的，应当依法承担赔偿责任。
Whoever manipulates the securities market shall be liable in damages in accordance with the law, if the manipulation causes any loss to investors.
《证券法》第一百九十二条规定：
违反本法第五十五条的规定，操纵证券市场的，责令依法处理其非法持有的证券，没收违法所得，并处以违法所得一倍以上十倍以下的罚款；没有违法所得或者违法所得不足一百万元的，处以一百万元以上一千万元以下的罚款。单位操纵证券市场的，还应当对直接负责的主管人员和其他直接责任人员给予警告，并处以五十万元以上五百万元以下的罚款。
Whoever manipulates the securities market in violation of Article 55 of this Law shall be ordered to dispose of the illegally held securities in accordance with the law and fined not less than one nor more than ten times its illegal income therefrom, which shall be confiscated, or if there is no such illegal income or the illegal income is less than one million yuan, fined not less than one million yuan nor more than 10 million yuan. If an entity manipulates the securities market, the directly liable executive in charge and other directly liable persons shall also be warned and each be fined not less than 500,000 yuan nor more than five million yuan.
